Assumption of Risk, Waiver and Liability Agreement

Important: This agreement affects legal rights. Each participant should read it carefully before booking, entering the playing area, or participating in pickleball activities at Tig's Rally Zone.

1. Voluntary participation and fitness

I choose to participate voluntarily. I confirm that I am physically and medically able to play safely, or that I have consulted a qualified health professional before participating. I will not play while impaired or when an injury, illness, medication, or other condition makes participation unsafe.

2. Acknowledgment of inherent risks

I understand that pickleball and use of an outdoor sports facility involve inherent and reasonably foreseeable risks, including:

• Slips, trips, loss of balance, and falls, including risks from fast movement, wet or uneven surfaces, and changing weather conditions.
• Collisions with players, guests, fences, posts, nets, court fixtures, or other objects.
• Being struck by a ball, paddle, or equipment.
• Strains, sprains, fractures, cuts, bruises, eye or head injuries, dehydration, heat-related illness, cardiac events, and aggravation of an existing medical condition.
• Serious injury, permanent disability, or death in rare cases.

3. Assumption of risk

I understand the nature of these risks and voluntarily accept the risks inherent in normal pickleball play and use of the facility. I accept responsibility for injuries, losses, or damage caused by my own conduct, condition, decisions, or failure to follow rules and instructions.

4. Safety rules and unsafe conditions

I will follow posted rules and reasonable staff instructions, use the courts and equipment properly, remain aware of nearby players and court boundaries, and stop playing if conditions appear unsafe. I will promptly report hazards, damaged equipment, injuries, or unsafe conduct to staff.

5. Release and limitation of liability

To the fullest extent permitted by Philippine law, I release and hold harmless Tig's Rally Zone and its owners, staff, representatives, and authorized agents from claims arising from the inherent risks of pickleball, my own acts or omissions, the acts or omissions of other participants or guests, or my failure to follow rules or instructions.

This agreement does not waive any right or duty that cannot lawfully be waived and does not release any person or business from gross negligence, willful misconduct, intentional harm, or other liability that Philippine law does not permit to be excluded.

6. Personal property

I am solely responsible for safeguarding my personal belongings, including cash or money, phones, wallets, jewelry, bags, clothing, paddles, equipment, and other valuables. I will not leave valuables unattended. Tig's Rally Zone does not accept custody of personal belongings and is not responsible for items that are lost, misplaced, stolen, or damaged on the premises, except where liability cannot lawfully be excluded.

7. Emergency assistance

If I am injured or become ill, I authorize Tig's Rally Zone staff to contact emergency services and provide reasonable assistance. I understand that medical personnel may not be present at the facility and that I am responsible for medical, transport, and related costs incurred on my behalf.

8. Minors and group bookings

A parent or legal guardian must review and accept this agreement for any participant who is a minor and remains responsible for the minor's supervision and compliance with facility rules. A person booking for a group must share these rules and this agreement with every participant before play; each adult participant is responsible for reviewing and accepting the terms for themselves.

9. Governing law and severability

This agreement is governed by the laws of the Republic of the Philippines. If any part is found invalid or unenforceable, the remaining parts will continue to apply to the fullest extent permitted by law.

10. Voluntary acknowledgment

By accepting this agreement, I confirm that I have read and understood it, had the opportunity to ask questions, and accept it freely and voluntarily without relying on any promise that the activity is risk-free.
